1. Introduction
Welcome to Your Tune (www.yourtune.co.nz). These Terms and Conditions ("Terms") govern your use of our website and the purchase of personalised, AI-generated songs from Your Tune. By placing an order, you agree to be bound by these Terms.
Your Tune is operated by Ops-on-Demand ("Your Tune", "we", "us", or "our"), based in Auckland, New Zealand. You can contact us at info@yourtune.co.nz.
These Terms are governed by New Zealand law, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Contract and Commercial Law Act 2017. Nothing in these Terms limits any rights you may have under New Zealand consumer protection legislation.
2. Our Products
Your Tune offers two types of personalised, AI-generated songs:
2.1 Personalised Song
A song generated for a specific occasion (such as Mother's Day, Father's Day, a Birthday, Anniversary, or Wedding). You choose from a set of existing song titles, a genre (Country, Rock, Pop, or R&B), and a voice type (Male or Female). You provide the recipient's name, your name, and your email address. The song is generated using fixed lyrics personalised with the recipient's name and delivered to you as an MP3 within 24 hours.
Song previews on our website are sample generations. Because every song is freshly AI-generated for your order, your delivered song may sound slightly different from the preview. This is a feature of the AI generation process — it is what makes your song unique — and does not constitute a defect. See Section 4 for more detail.
2.2 Fully Customised Song
A one-of-a-kind song written and generated entirely around the information you provide. You tell us as much as you like about the subject of the song and the style of music you would like, and we will create a set of original lyrics and generate a song just for you.
The Fully Customised Song process works as follows:
- You purchase the Fully Customised Song and submit your brief — including details about the subject, the occasion, and your preferred musical style — by email to info@yourtune.co.nz or via the form on our website.
- We will generate your song and deliver a first version to your nominated email address within 24 hours of receiving your completed brief.
- You are entitled to request up to two (2) rounds of lyric changes. Each round must be submitted as a single set of requested changes. We will regenerate and redeliver your song within 24 hours of receiving each change request.
- After two rounds of lyric changes have been made, or after you confirm you are happy with the song (whichever comes first), the song is considered final and no further changes will be made.
Please note: lyric change requests apply to the written lyrics only. We cannot guarantee that specific changes to musical style, tempo, instrumentation, or vocal character can be made once the brief has been submitted, as these are determined by the AI generation process. We will use reasonable efforts to honour your stylistic preferences within the capabilities of the technology.
As with all AI-generated music, each generation is unique and may vary slightly in sound even when the same inputs are used. This variation is inherent to the process and does not entitle you to additional changes beyond the two included rounds.
3. Ordering and Payment
3.1 How to Order
No account registration is required. For a Personalised Song, complete the checkout on our website. For a Fully Customised Song, purchase via our website and then submit your brief by email to info@yourtune.co.nz or via the form on our website. By placing an order you confirm that the details you provide are accurate and complete.
3.2 Order Confirmation
Your order is accepted, and a binding contract formed, when you receive an order confirmation from us. For Fully Customised Songs, production will not begin until we have received your completed brief.
3.3 Payment
Payment is accepted by credit card (Visa, Mastercard), debit card, and any other methods displayed on our website. All payments are processed securely through our third-party payment provider. Your Tune does not store your card details.
3.4 Failed Payments
If your payment is unsuccessful, your order will not be processed. Please check your payment details and try again, or contact us at info@yourtune.co.nz.
4. AI-Generated Songs and Variation
All Your Tune songs are created using AI music generation technology. Every generation is unique — even when the same lyrics and style inputs are used, the resulting song may differ slightly in arrangement, instrumentation, tempo feel, or vocal texture. This is an inherent characteristic of AI-generated music, not a fault.
By purchasing any product from Your Tune, you acknowledge and accept that your song is an AI generation and may sound different from any preview or previous version, and that natural variation in AI output does not entitle you to a refund or additional revisions beyond those included with your product.
5. Delivery
All songs are delivered as MP3 files to the email address you provide at checkout.
- Personalised Songs are delivered within 24 hours of your order being confirmed.
- Fully Customised Songs are delivered within 24 hours of us receiving your completed brief. Each subsequent revision will be delivered within 24 hours of us receiving your change request.
Delivery times may be longer during peak periods, public holidays, or due to circumstances outside our control. We will notify you if this applies to your order.
You are responsible for providing a correct and active email address. Your Tune is not responsible for non-delivery caused by an incorrect email address, a full inbox, or your email provider's spam filters. If you have not received your song within the expected timeframe, please check your spam or junk folder and then contact us at info@yourtune.co.nz.
6. Consumer Guarantees and Your Rights
If you are purchasing for personal, domestic, or household use, the Consumer Guarantees Act 1993 (CGA) applies. Our Products must be of acceptable quality and fit for their described purpose. Nothing in these Terms excludes or limits your rights under the CGA.
Where the CGA does not apply (for example, where you are purchasing for business purposes), our liability is limited to the maximum extent permitted by law.
7. Refunds and Revisions
7.1 Personalised Songs
Because each Personalised Song is custom-generated for your order, we are generally unable to offer refunds once your song has been generated and delivered. We will provide a refund or regenerate your song at no charge if:
- A technical fault in the file prevents you from playing it.
- The song was not delivered within 24 hours and we are unable to resend it.
- You were charged in error.
- The song does not match the genre, voice type, or recipient name you provided (where the error is ours).
We do not offer refunds on the basis of personal preference or because your song sounds different from the website preview. See Section 4.
7.2 Fully Customised Songs
Because a Fully Customised Song is created entirely to your brief, and because you have the opportunity to request up to two rounds of lyric changes, we do not offer refunds once the song creation process has begun (i.e. once we have received your brief and commenced work).
We will regenerate or remedy your song at no charge if:
- A technical fault in the file prevents you from playing it.
- The song was not delivered within 24 hours of receiving your brief or change request, and we are unable to resend it.
- You were charged in error.
We do not offer refunds on the basis that the final song does not meet your expectations after your two included rounds of lyric changes have been used, or because of natural variation in AI-generated sound as described in Section 4.
7.3 How to Request a Refund
Contact us at info@yourtune.co.nz within 14 days of your order with your order details and a description of the issue. We aim to respond within 3 business days. Your rights under the Consumer Guarantees Act 1993 are not affected by this policy.
8. Licence and Permitted Use
When you purchase any song from Your Tune, you are granted a non-exclusive, non-transferable, personal licence to:
- Download and keep the MP3 file for your own personal use.
- Play the song privately or share it with family and friends as a personal gift.
- Post the song to your personal social media accounts for non-commercial, personal sharing, provided you do not claim authorship or ownership of the song.
Your licence does not permit you to:
- Sell, resell, sublicence, or commercially exploit the song in any way.
- Use the song in any commercial project, advertisement, film, podcast, or broadcast without our prior written consent.
- Publicly perform the song in a venue or event setting.
- Modify, remix, or create derivative works from the song.
- Distribute the song to third parties beyond personal gifting.
- Use the song to train artificial intelligence models or machine learning systems.
If you wish to use a song for commercial purposes, please contact us at info@yourtune.co.nz to discuss a commercial licence.
9. Intellectual Property
All songs generated by Your Tune, together with our website content, logo, and brand materials, are protected by copyright and other intellectual property rights. Nothing in these Terms transfers ownership of any intellectual property to you. You receive a personal use licence only, as described in Section 8.
You must not remove, alter, or obscure any metadata, credits, or copyright notices associated with your song. Unauthorised use of our intellectual property may give rise to a claim for damages and may constitute an offence under the Copyright Act 1994 (New Zealand).
10. Privacy
Your Tune collects your name, the recipient's name, your email address, and (for Fully Customised Songs) the personal information you include in your brief, for the purpose of generating and delivering your song and providing customer support. We handle your personal information in accordance with the Privacy Act 2020 (New Zealand).
We will not sell or share your personal information with third parties except as necessary to process your order (for example, our payment provider and AI music generation service) or as required by law. Our full Privacy Policy is available at www.yourtune.co.nz.
11. Limitation of Liability
To the maximum extent permitted by applicable New Zealand law:
- Your Tune's total liability for any claim is limited to the amount you paid for the relevant song.
- Your Tune is not liable for any indirect, consequential, incidental, or special loss or damage, including loss of enjoyment or sentimental loss.
- Your Tune is not responsible for loss caused by events outside our reasonable control, including internet outages, email provider failures, or AI service downtime.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or any liability that cannot be excluded under applicable New Zealand law.
12. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on our website. Your continued use of our website or purchase of Products after any change constitutes your acceptance of the updated Terms.
13. Dispute Resolution
If you have a concern, please contact us first at info@yourtune.co.nz. We aim to respond within 3 business days. If we cannot resolve the matter informally, you may seek resolution through:
- The Disputes Tribunal of New Zealand (for claims up to NZD $30,000).
- The New Zealand District Court or High Court, depending on the value of the claim.
- The Commerce Commission (for fair trading complaints).
These Terms are governed by the laws of New Zealand and both parties submit to the jurisdiction of the New Zealand courts.
14. General
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Your Tune in relation to your purchase. A failure to enforce any right under these Terms does not constitute a waiver of that right.
